AC: Alberta Culture
Alberta Multimedia Development Fund Grant Agreement: the legal contract between Alberta and the Applicant which spells out the terms and conditions of Alberta’s financial commitment to the Applicant. The Agreement is signed by both Alberta and the Applicant.
Albertan Ownership of the Production: directly affects the level of funding as described in the Guidelines and the Grant Agreement.
AMDF: Alberta Multimedia Development Fund
Amending Agreement: contains subsequent and mutually agreed changes to the terms of the Grant Agreement.
APG: Alberta Production Grant
Applicant: the production company with whom the Grant Agreement is signed.
Co-Producer: an individual who shares with one or more others decision-making, creative and financial control and exploitation of the Production, but otherwise meets the definition of “Producer” Details are found in the Guidelines.
Deliverables: the required project outcomes to be provided by theApplicant, as detailed in the respective program section of the AMDF Guidelines.
Effective Date: the date this Agreement is signed by the authorized representative of the Government of Alberta.
Eligible Alberta Costs: production expenditures where the cost is incurred in Alberta as described on the “Eligible Costs Worksheet”. Qualifying details are found in the Guidelines.
Eligibility Requirements: The Applicant must be incorporated or registered to do business in Alberta and be in good standing with Corporate Registry and with the AMDF.
Event of Default: rules which govern termination or expiry of the APG described in Section 11.1 of the Grant Agreement.
Funding cap: the maximum funding available to any project or series is $5 million dollars.
Grant: the sum to be paid to the Applicant as outlined in the Letter of Intent. The Grant is paid in accordance with the payment requirements in the respective program Guidelines.
Head and Tail Credits: the credits appearing respectively at the beginning and the conclusion of a film or program.
Key Creative Position: includes the positions of writer, director, production manager, art director, production designer, editor, director of photography, composer, costume designer, and up to 3 performers per Production in either lead or supporting roles.
Letter Of Intent: a letter signed on behalf of Alberta which offers the details of the Grant Agreement to the Applicant.
Loan Agreement: the contract between the Applicant and the Applicant’s Lender that loans money to the Applicant. Signing parties are the Applicant and the Applicant’s Lender.
Non-eligible productions include:
(i) News, current events or public affairs programming, or a program that includes weather or market reports;
(ii) Talk shows;
(iii) Production in respect of a game or contest (other than a production directed primarily at minors);
(iv) Sports event or activity;
(v) Productions that solicits funds;
(vi) Reality TV (this includes production that consists of scenes recorded on amateur home video cameras or private or public authority surveillance equipment, and programming currently known as court television and similar formats);
(vii) Pornography;
(viii) Advertising;
(ix) Production produced primarily for industrial, corporate, or institutional purposes;
(x) Production other than documentary, all or substantially all of which consists of stock footage;
(xi) consol or online video games (other than a production directed primarily at minors or relating specifically to the characters and premise of a licensed and commercially distributed television program or feature film);
(xii) software/programming applications; and
(xiii) video distribution platforms or aggregators.
Notice of Assignment and Irrevocable Direction: is a legal document in which the Applicant assigns the Grant to the Applicant’s Lender as collateral. Signing parties are AMDF and the Applicant.
Producer: an individual:
Production: the film or TV project which is being funded.
Projected Deliverable Date: the date by which all Deliverables must be received by the AMDF.
Qualified Trainee: an apprentice or intern in a Key Creative Position who is qualified by experience or education and will receive an industry-standard on-screen credit in the credits of the Production (approved by the AMDF).
Stream 1 funding: sets the Grant at 29% of Eligible Alberta Costs providing there is 30 – 100 per cent Albertan ownership and at least six Albertans in Key Creative Positions.
Stream 2 funding: sets the Grant at 25% of Eligible Alberta Costs for 0 – 29 per cent Albertan ownership and at least four Albertan in a Key Creative Position.
Bonus funding in Stream 1: For shoots that last more than 30 consecutive days, or 300 person hours for digital projects, one per cent additional funding will be granted to a maximum of 30 per cent total funding.
Bonus funding in Stream 2: For shoots that last more than 30 consecutive days, or 300 person hours for digital projects, one per cent additional funding will be granted to a maximum of 26 per cent total funding.
